Terms of sale

The present conditions of sale are concluded on the one hand by the individual company Nord Laine whose registered office is located at 12B Allée des Seychelles 33600 Pessac FRANCE, hereinafter referred to as "Nord Laine", and on the other hand, any individual or legal entity wishing to use its services and hereinafter referred to as "the Customer".

1. Application of general terms and conditions - Opposability
The performance of any service by Nord Laine implies acceptance by the Customer of the present general terms and conditions, and waiver of the Customer's own general terms and conditions of purchase. Any contrary condition will therefore be, in the absence of express acceptance, unenforceable against Nord Laine, regardless of when it may have been brought to its attention.

The fact that Nord Laine does not avail itself at one time of any of these general conditions of sale, can not be interpreted as a waiver to avail itself later of any of the said conditions.

2. Products
Nord Laine endeavours to provide as much detail as possible about the Products sold in the online Boutique.
Thus, the products sold on the Online Shop are identified by one or more photos, a descriptive text and a price in euros (€) all taxes included.

3. Prices
Prices are quoted in euros and include all taxes.

The price of the articles is the one mentioned on the site. They are increased by the amount of the delivery charges which will appear following the order, according to the amount of the order and the delivery method and country.

PDF files ordered are sent automatically by e-mail upon payment, so there are no delivery charges applied to these items.

4. Order
Automatic recording systems are considered as proof of the nature, content, amount and date of the Order.

Once the Customer has selected Products for his/her Order by adding them to his/her shopping basket, he/she will be able to modify his/her choices and correct any errors in the Order summary. The Customer must then approve the present General Terms and Conditions of Sale before confirming and paying for the Order.

Nord Laine reserves the right to refuse or cancel any Customer Order, in particular in the event of insolvency of said Customer or in the event of non-payment of the Order concerned, of a previous delivery or of a dispute relating to the payment of a subsequent order.

The information provided by the Customer at the time of placing the Order is binding on the Customer. The Service Provider shall not be held liable for any errors made by the Customer in entering the contact details of the Order recipient, nor for any loss or damage resulting from such errors. The reshipment of a parcel that could not be delivered due to an error on the part of the Customer will be at the Customer's expense.

Validation of the order implies unreserved acceptance of the special conditions of sale specific to each of the products in the order (name, price, color, quantity, particularity of the products).

The customer acknowledges having read and accepted the flat-rate delivery charges.

The sales contract is only formed once full payment of the order has been validated with the payment organizations (Paypal or Stripe). Once the payment has been validated, Nord Laine will send confirmation of the order by e-mail to the address communicated by the Customer. Nord Laine cannot be held responsible for any typing error in the e-mail address.

In the event that a product is no longer available for sale, Nord Laine undertakes to immediately inform the Client by e-mail, who will have the possibility of requesting, within 7 days, the substitution of the product by another of his/her choice at an equivalent price, or to be reimbursed for the price of the missing product.

The Customer may not resell the products. Any order placed by a Customer is for personal use or for the personal use of the person in whose name the delivery is to be made.
The Customer is solely responsible for the effective payment of the products purchased and for the contact details provided for the delivery.

5. Payment
The price invoiced to the Customer is that indicated on the Order confirmation sent by e-mail by Nord Laine.

The Customer may pay for his Order by credit card or Paypal account. Payment on delivery (cash on delivery) is not offered.

Payments by Paypal account are made via the Paypal interface and are secured by the Paypal platform. It is not necessary for the customer to have a Paypal account to pay for an order: it is possible to pay directly with a bank card. Credit card payments directly on the site are secured by the Stripe platform.
The customer guarantees that he/she is fully authorized to use a bank card and that the card gives access to sufficient funds to cover all costs associated with placing an order on the nordlaine.com website. Only persons legally capable of entering into contracts concerning the goods and services offered on the site may order on the nordlaine.com site.

The date of validation of the order corresponds to the date of online payment by credit card or Paypal account.

If payment for the Order is not received within seven (7) days of the Order being placed, Nord Laine may cancel the Order, after informing the Customer by email.

6. Delivery
Nord Laine undertakes to deliver the items ordered as quickly as possible, and within a maximum of 30 days, as evidenced by the postmark. Except in special cases or when one or more products are unavailable, all products ordered will be delivered at once. This also applies to pre-ordered items: the rest of the order will be delivered at the same time as the pre-ordered items, as soon as we receive them.

However, if the products ordered have not been delivered within 15 days of the indicative delivery date, for any reason other than force majeure, the sale may be cancelled at the written request of the Customer or Nord Laine. The sums paid by the Customer will then be returned to him without delay, to the exclusion of any compensation or deduction.

The parcel is sent to the delivery address provided by the Customer. In the event that the address provided does not allow for proper delivery of the order, resulting in the return of the order, the Customer will be responsible for the reshipment of the parcel.

For France, products will be sent by Colissimo with or without delivery against signature, to the customer's home address or to a Mondial Relay point selected by the customer (closure of the relay point at the time of delivery, and therefore delivery to another relay point nearby, cannot be a reason for reimbursement of postage costs, the selection of the relay point being indicative and not guaranteed by Mondial Relay) where the parcel will be handed over against signature.

For other destinations, products will be sent by Colissimo, DHL, or any other service provider chosen according to the destination, but always with a tracking option. Shipments outside the EU may be subject to customs formalities and the payment of customs duties and taxes in accordance with the legislation and rates of the country concerned. These are the responsibility of the customer and cannot be assumed by Nord Laine.

The client will be delivered to the address registered as the delivery address at the time of the order.

Nord Laine cannot be held responsible for any delivery problems, loss or deterioration of parcels, which would be the responsibility of La Poste or Mondial Relay.
In the event of loss or damage, an investigation will be requested from the Post Office or Mondial Relay; in the event of compensation, this will be paid to the customer in the form of a refund.

In the case of a parcel indicated as "delivered" by the Post Office, and which the addressee has not received, the Post Office in this precise case will in no way acknowledge its responsibility. It will not grant any compensation even if it is at fault. Nord Laine strongly recommends delivery against signature to avoid this situation.

Upon receipt of his order, the Customer must check its contents and report within 5 days via the contact form any error or missing item. Nord Laine will then rectify the situation immediately (new shipment or refund).

Books and magazines
Bookstore items (books and magazines) can only be shipped to the following countries: France, Monaco, Netherlands, Luxembourg, Spain, Belgium, Portugal.

7. Delivery of downloadable products
Downloadable products are delivered via links to the corresponding files (pdf files or archive files in zip format, as the case may be). These links are available after validation of the order by two means:

an email sent to the email address registered by the Customer in his customer account
in the Customer's account on the Online Shop. Downloading is activated immediately upon validation of payment.

8. Right of withdrawal, returns and refunds
In accordance with Article L 121-20 of the French Consumer Code, the Customer has a period of fourteen (14) clear days from receipt of his Order to exercise his right of withdrawal from Nord Laine. In the event of exercising the right of withdrawal, the Customer must return the purchase intact and in its original packaging, at his/her own expense. In particular, the purchase must not have been in contact with a smoking environment or with animals, which would make it impossible to sell it again. Proof of purchase will also be required. The right of retraction cannot be exercised for gift cards, magazines, damaged, opened, stained or spoiled articles, or wool that has been baled by us at the customer's request, or sold in skeins that have been baled, or wool that has been knitted. The return must be made by Colissimo with signature: in case of loss of the package, Nord Laine can not be held responsible. Nord Laine undertakes to reimburse the sums paid by the Purchaser, with the exception of the costs of returns, within thirty (14) days of the exercise of this right of withdrawal, by the same means of payment as that chosen at the time of the order.

In accordance with article L 121-20-2 of the French Consumer Code, the right of withdrawal cannot be exercised for any supply of goods made to the Customer's specifications or clearly personalized. Consequently, the Customer may not exercise his right of withdrawal for any order of products made at the Customer's request.

Nord Laine will not reimburse downloadable Products if the Customer has downloaded them at least once.

9. Responsibilities
Nord Laine cannot be held responsible for damages of any kind, whether material, immaterial or physical, which may result from a malfunction or misuse of the Products ordered.
The products sold on the site nordlaine.com are presented with the greatest possible accuracy, however the parties agree that no one can guarantee the proper functioning of the Internet as a whole, consequently, Nord Laine cannot be held responsible for technical failures due to third parties likely to alter the quality of colors, texts, sounds, images and conditions of accessibility to the site nordlaine.com.

In the event of difficulties in the fulfilment of this contract, the Client and Nord Laine reserve the right, prior to any legal action, to seek an amicable solution.

10. Guarantees
Nord Laine controls the quality of products sent by its suppliers. However, Nord Laine cannot guarantee the quality of all products sent to it without the risk of altering the products and their packaging. Consequently, Nord Laine cannot guarantee that the balls of knitting yarn and other products offered on the site are completely free of defects. In addition, some items may be hand-made or hand-dyed. Nord Laine cannot therefore guarantee that the colors, dimensions or weights of the items offered for sale will match perfectly.

11. Confidentiality
The provision of personal information collected for the purposes of distance selling is compulsory, as this information is essential for the proper processing and routing of Orders and for the preparation of invoices and warranty contracts.

All information collected by the Service Provider from the Customer will be kept confidential by the Vendor. The Service Provider undertakes not to communicate this information to any third party.

12. Intellectual property
The nordlaine.com website is the exclusive property of Nord Laine, and is governed by French law. The general architecture, content, live and still images, sounds, processes, products and all other elements that are part of the website are the exclusive property of Nord Laine.

Any total or partial use, copy, reproduction, publication, downloading, display, transmission or dissemination of this site without the authorization of Nord Laine is prohibited and will be considered an infringement of the provisions of the French Code of Intellectual Property, unless expressly authorized by law.

13. Proof
Nord Laine will systematically confirm the Customer's order and its dispatch by email.

For any payment by credit card, the validation of the payment by the Bank of Nord Laine will have value of proof of the sale contract.

14. Competent court for disputes
These General Terms and Conditions of Sale are governed by French law. They apply to the whole of France and to the rest of the world insofar as the specific legislation in force in each country is respected. In the absence of amicable agreement, any dispute between the parties arising out of or in connection with this contract shall be submitted to the jurisdiction of the Tribunal de Commerce of the defendant's place of residence. French law shall apply.

15. Data protection
The information requested on the nordlaine.com website is necessary for the registration and follow-up of orders.

In order to respect the Customer's privacy, the information transmitted is under no circumstances transferred, sold or rented to other companies or organizations.

The customer has the right to modify, oppose, rectify and delete data concerning him/her. The Customer may exercise this right by writing to the contact address.
